YesChef Ltd. d/b/a YesChef ("YesChef," "we," "us," "our") provides services through our website located at YesChef.me and mobile applications (collectively, the "Service(s)"). These Terms of Service ("Terms") govern your use of our Services. PLEASE READ THESE TERMS CAREFULLY - THEY CONTAIN LEGAL OBLIGATIONS AND LIMIT YOUR RIGHTS IN CASE OF A DISPUTE.

We reserve the right to modify these Terms at any time. We will notify you of material changes via the Service, by email, or as required by law. Your continued use of the Service after changes take effect indicates your acceptance.

You may use our Service for personal, non-commercial purposes only. You may not record, redistribute, modify, or publicly perform any content. Your limited license may be revoked at our sole discretion.

You must provide accurate registration data. If under 13, you may not use the Service. If under 18, you must obtain parental or guardian consent.

Keep your password secure and notify us immediately of unauthorized use. We are not liable for account misuse caused by your failure to safeguard credentials.

We may modify or discontinue the Service at any time without notice. Your data may be deleted after inactivity unless retention is required by law.

Mobile usage may incur standard data and messaging charges from your carrier.

Subscriptions automatically renew unless canceled before the next billing date. You can cancel anytime at app.yeschef.me.

Refund Policy:

• We offer a full refund for first-time purchases requested within 30 days of purchase.
• Renewals are non-refundable unless required by law or granted at our sole discretion.
• Refunds are processed through the same method of payment.

Gift Purchases & Promotions:

• Unredeemed gifts are refundable within 30 days of purchase.
• Once redeemed, gifts are non-refundable.
• 2-for-1 deals are refundable only if the recipient hasn't redeemed the gift. If refunded, the free membership will be voided.
• Promotional and complimentary access (e.g. influencer giveaways) is non-refundable.

Regional Rights:

• EU/EEA residents have a 14-day right of withdrawal. Email [email protected] to exercise this right.
• California and Connecticut residents may cancel within 3 business days for a full refund.
• App Store Subscriptions: If you subscribed via Apple or Google, refunds must be requested via the respective platform, and their refund policy will apply.

You agree not to misuse the Service, upload harmful content, violate laws, or infringe upon others' rights. We may remove content and suspend accounts at our discretion.

YesChef owns or licenses all content and software on the Service. You may not copy, distribute, modify, or reverse-engineer any part of the platform.

You retain ownership of content you post, but you grant us a perpetual license to use it worldwide for any purpose, including commercial use. You agree we may preserve or disclose your content as required by law.

Content on YesChef is for informational purposes only and is not a substitute for medical advice. Consult your physician before changing your diet or physical activity.

We may link to other websites. We do not endorse or control third-party content or services and are not responsible for their terms or practices.

We provide the Services "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free access. We disclaim all implied warranties to the fullest extent permitted by law.

We are not liable for indirect, incidental, or consequential damages. Our total liability shall not exceed $100 or the amount you paid in the last 6 months, whichever is greater.

Disputes will be resolved by binding arbitration in Tel Aviv, Israel, administered by the International Chamber of Commerce (ICC) under its rules then in effect, under Israeli law. The arbitration shall be conducted in the English language in front of a single arbiter. This arbitration obligation applies equally to YesChef and to you. Class actions and class arbitrations are not permitted, except that nothing in this clause waives your right to seek public injunctive relief in a court of competent jurisdiction to the extent such waiver is unenforceable under applicable law. U.S. users retain access to small claims court. For a consumer's first arbitration demand within any 12-month period arising from a distinct incident or dispute, and provided the claim is not later determined to be frivolous or brought in bad faith, arbitration will be conducted virtually on a documents-only basis for claims below $10,000, and YesChef will bear arbitration costs exceeding the filing fee of the consumer's local small claims court. All other claims shall proceed under standard ICC fee allocation rules. Residents of the European Union or United Kingdom are not subject to this arbitration requirement and may bring claims before the courts of their EU member state of habitual residence under Brussels Regulation (Recast) Article 18, or, for UK residents, under the Consumer Rights Act 2015. Mandatory consumer protection provisions that cannot be excluded by contract in your country of habitual residence, wherever located, remain available to you notwithstanding this clause. You may opt out of arbitration within 30 days of first accepting these Terms, or within 30 days of notice of any material amendment to this clause, by emailing [email protected] with your full name and account email, and including a statement expressly opting out of arbitration under this Section. This Section is severable; if any part is found unenforceable, the remainder remains in effect, and arbitration will proceed as to any remaining claims or parties.

We may suspend or terminate your account at any time for violations of these Terms. You may cancel at any time via your account settings.

These Terms are governed by Israeli law. Nothing in this clause deprives you of the protection of any mandatory consumer protection provisions of the law of your country of habitual residence that cannot be excluded by contract, including but not limited to residents of the European Union, United Kingdom, and United States. YesChef Canada Ltd. may process payments on behalf of YesChef Ltd.

If any part of these Terms is found invalid, the remainder remains in effect. These Terms constitute the entire agreement between you and YesChef.
